- Legal description of subject property (bring in your Grant Deed or a copy of your title policy – it will be returned to you at the close of escrow).
- Name, address and loan number of each lender to whom you are making loan payments (bring in payment coupon showing balances, loan numbers, etc. on all loans against your property).
- The approximate unpaid balance of each loan and the “type” of loan – is it an FHA, VA, State of California, or Conventional loan?
- Copy of your existing fire insurance policy if the policy is to be transferred to the buyer at the close of escrow.
- The name of the Homeowner’s Association, address, phone number, and the amount of the monthly dues. Copies of the By-Laws, Articles of Incorporation and Covenants, Conditions and Restrictions – CCR’s must be delivered to the buyer prior to the close of escrow.
- Current Tax Statement and receipts, if available.
- Complete list of tenants, if any, including amounts of rents, date to which paid, the amounts of security deposits, and copies of all leases.
- Description of personal property included in the sale.
- Name, address and phone number of each real estate broker to be paid a commission.
- Name of the title company to issue policy and the type of title insurance to be furnished.
- Is there Water Stock for the property? If so, furnish escrow with the name, address of the Water Company together with the Stock Certificate for property Assignment and proration.
- Your exact name, marital status and manner in which you wish to acquire title. (You might want to consult you attorney and/or CPA regarding this. There are many ways you may want to hold title such as, Joint Tenants, Community Property, Community Property with Right of Survivorship, Separate Property, etc.)
- Name and address of your proposed lender. Also, the name and phone number of your loan representative.
- Terms of your new loan – how much do you want to borrow – what is your interest rate?
- Your fire insurance agent’s name, address and phone number and amount of insurance to be written.
- Deliver to escrow a copy of the Residential Purchase Agreement and Joint Escrow Instructions, fully executed by all parties involved.
- Fully executed copies of all counter offers, if any
- Name, address and phone number of each real estate agent to be paid a commission.
- Is this escrow contingent upon the closing of another escrow
- Is this escrow to close concurrently with another escrow, but not necessarily contingent upon that escrow?
- Name and address of lender for Buyer’s new loan.
- Name of title company to issue title insurance policy, along with the type of policy requested and amount of coverage.
- When do you want the escrow to close?
- What items are to be prorated thru escrow?
- Is there Water Stock for the property? If so, furnish escrow with the name, address of the Water Company together with the Stock Certificate for property Assignment and proration.
- Who is the Termite Company (Agent orders the termite report and completion)
- All terms of the sale of which escrow is to be concerned.
